  • 1959 年新加坡自治初期,执政者的国策之一便是构思如何通过立法来实现男女平权的情况。两年后,《妇女宪章》通过并正式立法。
  • 《妇女宪章》确立一夫一妻婚姻制、制定 18 岁为最低结婚年龄、让女性婚后保有个人资产、制定重婚可被判坐牢和罚款,及通奸可作为离婚的理据等。
  • 2016 年,《妇女宪章》有所修整,修宪秉持男女平权的立法精神,持续改善社会政策及支援家庭。随着社会的发展,越来越多男性肩负家庭主夫的职能,让传统 “男主外女主内” 的家庭模式起了变化。这次修宪的一项重大修改,是允许在合法婚姻正式结束前就已经身残或染重病,并没有稳定收入而无法工作的丈夫及前夫,向婚姻伴侣要求赡养费以维持生活。
ETYMOLOGY
  • At the beginning of Singapore’s self-governance in 1959, one of the national policies of the political rulers was to conceptualise how to achieve equal rights for men and women through legislation. Two years later, the Women’s Charter was passed and formally legislated.
  • The Women’s Charter institutionalises monogamous marriages, sets the minimum age for marriage at 18 years old, allows women to keep their personal assets after marriage, stipulates that bigamy is liable for a jail term and fine, and that adultery can be used as grounds for divorce. It also provides for protection against family violence and imposes criminal penalties for offences against women and girls.
  • In 2016, the Women’s Charter was revised to uphold the legislative intent of equal rights for men and women to continuously improve social policies and support families. As society develops, an increasing number of men have taken on the role of the househusband, which has challenged the traditional family model of the male breadwinner and the housewife. A major change in this constitutional amendment is to allow the husband or ex-husband to apply for alimony from his spouse if he has been physically disabled or seriously ill before the legal marriage formally ends, has no stable income, and is unable to work.
