  • 英语“adjudication of bankruptcy”的意译。
  • 政府部门里破产者的档案被称为穷籍（bankruptcy）。
  • 在新加坡，申请破产的人可以是债务人本身，也可以是债权人。
  • 若债务人无法偿还新币15,000元或该数额以上的债务，债权人可以对债务人提出破产诉讼。债权人对债务人提出破产诉讼后，债务人会收到法定要求偿还书（Statutory Demand），若债务人还是无法还债，债权人可以要求债务人申请破产。
  • 申请破产后，破产者会受到法律的约束。法定管理人（official assignee）将接管破产者的事物（如财产管理、债务管理等）。债权人有权变卖破产者的资产以偿还债务。
  • 不过破产者也有受到保护的资产，即不能变卖以偿还债务的资产，包括政府组屋、公积金、配偶或子女的保险等。
  • 如果破产者要脱离穷籍，必须偿还一定数额的债务，并由高庭或法定管理人解除穷籍。
ETYMOLOGY
  • The Mandarin term “报穷” is a paraphrase of the English term “adjudication of bankruptcy”.
  • The Mandarin term “穷籍” refers to the bankruptcy register, which is stored by the relevant government department.
  • In Singapore, either a debtor himself or his creditor can file for bankruptcy.
  • If a debtor cannot repay debts of at least S$15,000, the creditor can file a bankruptcy lawsuit against the debtor. A Statutory Demand is then served on the debtor, who is required to respond. If the debt is still not repaid, the creditor can request the debtor to file for bankruptcy.
  • After filing for bankruptcy, the bankrupt will be bound by law. The official assignee will take over the affairs of the bankrupt (such as property management, and debt management). Creditors have the right to sell the bankrupt's assets to repay debts.
  • However, bankrupts also have protected assets. These assets cannot be sold to repay debts, including HDB flats, CPF funds, and insurance for their spouse or children.
  • If the bankrupt wants to be removed from the bankruptcy register, they must repay a certain amount of the debt. The High Court or a legal administrator shall then discharge the bankrupt from the bankruptcy register.
