A legal document (charge sheet) listing the facts and details of the accused’s offence.

由来
  • 被告初次出庭时,法庭会向被告宣读控状。若被告承认犯下控状中指控的罪行,确认案情陈述书(Statement of Facts)对案件罪行所陈述的事实,便可以选择认罪,等待法官定罪。反之,被告也能选择不认罪,上庭受审。
  • 法官在审讯案件时,将会查证被告所面对的指控,评估案件相关的文件、录像、照片、物件、证人证词等的可信度,判定指控中的要件是否已证实,从而考虑被告是否应被判罪名成立或无罪放。
  • 被告被定罪并判刑后,只能就刑罚提出上诉,不能对控状提出异议或要求再审。
  • 相反的,若被告对控状有任何异议,可提出抗辩,法庭会定下日期进行审讯。

ETYMOLOGY
  • At the accused’s first appearance in court, the charge will be read out to him or her. If the accused admits to committing the crimes listed in the charge sheet and confirms the Statement of Facts, he or she can choose to plead guilty and await the judge’s sentence. Alternatively, the accused can refuse to plead guilty and claim trial.
  • During trial, the judge will review allegations faced by the accused and evaluate the validity of the documents, videos, photographs, objects, and witnesses’ testimonies related to the case to determine whether the elements in the charge have been made out and whether the accused is to be convicted or acquitted.
  • Once the accused is convicted and sentenced, he or she can only appeal against the sentence and cannot challenge the charge or request a retrial.
  • Conversely, if the accused has any objection to the charge, he or she can file a defence, and the court will set a date to try the case.
