  • 英语“remand”的意译。
  • 法庭在审案之前,被告可被暂时拘禁,以待法庭聆讯或进行审判。
  • 依据新加坡刑事程序法典(Criminal Procedure Code 2010),若法庭认为调查该案件需要被告的协助,法官可在受审前下谕令将被告暂时关押,以便协助警方或相关部门进行调查。
  • 被告在拘留期间将受到新加坡监狱管理局(Singapore Prison Service)的合法监护。
  • 在适当的条件下,法院或执法单位可准许被告被保释,倘若被告无法提供保释金,被告将会继续留在监狱。

ETYMOLOGY
  • The Mandarin term “还押” is a paraphrase of the English term “remand”.
  • Before trial, the accused may be remanded to await a court hearing or trial.
  • According to the Singapore Criminal Procedure Code 2010, if the court believes that investigation of the case requires the assistance of the accused, the judge can order the accused to be remanded before the hearing to assist the police or relevant departments.
  • During this period of detention, the accused is placed under the legal custody of the Singapore Prison Service.
  • If the situation permits, the court or law enforcement unit may grant bail to the accused. If the accused is unable to post bail, he or she remains in remand.

SAMPLE SENTENCE
The judge eventually sentenced the man to three weeks’ imprisonment and a S$1,000 fine. As he failed to pay the fine, he was imprisoned for two additional days instead. His sentence was backdated to 25 May, when he was placed in remand. (Lianhe Zaobao, 26/6/2021)
