  • 在新加坡司法机构中,上诉庭的司法员包括首席大法官(Chief Justice)、法院副院长(vice-presidents of the Court)及上诉法官(Justices of Appeal)。上诉庭为新加坡的最高法院及终审法院。
  • 若控方或辩方对高等法庭的判决有异议,皆可提出上诉,要求上诉重新裁判。
  • 依据1993年实施的《最高法院司法法令》(Supreme Court of Judicature Act),上诉庭拥有民事与犯罪上诉案件的审判权,但必须由三名或以上的上诉法官在场审案。此用意在于避免个人独断专行的审判,确保案件得到妥善的判决。
ETYMOLOGY
  • In the Singapore judiciary, the judicial officers of the Court of Appeal include the Chief Justice, the vice-presidents of the Court, and the Justices of Appeal. The Court of Appeal is the highest court in Singapore and the court of final appeal.
  • If the plaintiff or the defendant disagrees with the High Court’s judgment, either party can appeal to the Court of Appeal and request for a re-trial.
  • In accordance with the Supreme Court of Judicature Act 1993, the Court of Appeal has the power to hear civil and criminal appeal cases, although there must be three or more judges present. This is to prevent individual arbitrary judgments from being made and to ensure that cases are dealt with appropriately.
