Noun

A professional or group who, at the request of either the court or voluntarily, provides information or expertise to the court on legal disputes related to a case, in the absence of direct legal interests.

  • “法庭之友”,拉丁文称为 amicus curiae,英文称为 “friend of the court”。
  • “法庭之友”制度最初源于罗马法,后被英美习惯法 (Common Law) 所继承,在美国的司法体系下发展为一套颇具特色的法律制度。
  • 在该制度下,案件当事人以外的第三方可通过“法庭之友”的身份向法院提供法庭不知情的相关信息和意见,进而协助案件的审理过程,让法院更公正地做出裁决。
  • 法庭之友扮演着提供建议的角色,但法院不一定会采纳他们的建议。
  • 法庭之友参与诉讼的方式有两种:
    1. 递交法庭之友书状,在书状中详细载明自己的主张和理由;

ETYMOLOGY
  • The Mandarin term “法庭之友” is known as amicus curiae in Latin and “friend of the court” in English.
  • The amicus curiae system originated from Roman law and was later inherited in Common Law, which developed into a distinctive legal system under the United States judiciary system.
  • In this system, as an amicus curiae, a third party other than the parties of the case can provide the court with relevant information and opinions that it is unaware of, thus assisting the trial process and enabling the court to make a more just verdict.
  • The role of the amicus curiae is only advisory, and the court is not obligated to adopt their suggestions.
  • There are two ways for an amicus curiae to intervene in litigation:
    1. Submit an amicus curiae brief that states one’s arguments and reasons in detail;
    2. Directly participate in court trials and cross-examinations.
  • In 2010, then Chief Justice Chan Sek Keong announced the launch of the Young Amicus Curiae scheme. The scheme aims to give young lawyers the opportunity to collaborate with the court on novel legal arguments or on public policy, alongside other important topics.

Amicus curiae volunteers play a neutral role. In court, they may assist the defence, the prosecution, the defendants or the witnesses. They help the court attendees familiarise themselves with the environment and judicial procedures, as well as to know their rights, request an adjournment if necessary, and so on.
