  • 现今的公路交通法令（Road Traffic Act）于1961年首次宣读，是根据英国殖民地政府于1936年颁布的社区法例（Municipal Ordinance）修改而定的。
  • 在该法例规定下，开车人士在接受酒精测试时，若呼出的每100毫升气体所包含的酒精超过法定上限的35微克，初犯者可被罚款新币2,000元至10,000元或监禁长达12个月，或两者兼施。重犯者的刑罚是新币5,000元到20,000元的罚款和监禁长达两年。犯罪者将被吊销驾驶执照两年至五年。
  • 由于近年来醉酒驾车被控的案件有上升的趋势，法庭已对涉及个人伤害的酒驾案施以更重的监刑。修正后的公路交通法令，于2019年11月1日实施。法令中列出的“不负责任驾驶罪行”（irresponsible driving offences）分为两种：一、鲁莽或危险驾驶；二、粗心驾驶，其中再细分为不同等级的伤害，包括死亡、严重伤害、伤害及威胁生命。

ETYMOLOGY
  • The current Road Traffic Act was first read in 1961, drafted in accordance with the British government’s Municipal Ordinance in 1936.
  • Under the Road Traffic Act, if a breath alcohol test shows that a driver has a breath alcohol content of more than 35μg per 100ml of breath, first-time offenders may be fined between S$2,000 and S$10,000, and/or jailed up to 12 months. Repeat offenders may be fined between S$5,000 and SS20,000, and jailed up to two years. Offenders will have their licences suspended for two to five years.
  • As the number of drink-driving cases has been increasing in recent years, the court has imposed heavier penalties on drink-driving that causes injuries to others. The Road Traffic (Amendment) Act 2019 which took effect on 1 November 2019 classifies irresponsible driving offences into Reckless or Dangerous Driving and Driving Without Due Care or Reasonable Consideration. The Act further categorises these offences into four tiers based on the level of harm caused: Death, Grievous Hurt, Hurt and Endangers Life.
