  • 英语 “mandatory imprisonment” 的意译。
  • 按照新加坡刑事法典（Penal Code），若被告犯下特定罪行并被判罪名成立，法官需判处相同或大于该罪行规定的最低监禁期限的刑罚。
  • 在新加坡刑法中，设置强制性监禁是为了达到两个目标：一、对社会的威慑性作用；二、防止罪犯对社会造成更多危害的预防性作用。
ETYMOLOGY
  • The Mandarin term “强制性监禁” is a paraphrase of the English term “mandatory imprisonment”.
  • According to Singapore Penal Code, if the accused is found guilty of committing a crime, the judge must impose a sentence equal to or greater than the minimum term of imprisonment for the crime committed.
  • Under the Penal Code, mandatory imprisonment serves to achieve two goals: first, the deterrence on the society at large; second, the prevention of the criminal’s ability to cause more harm to society.

SAMPLE SENTENCE
According to the Communications and Multimedia Act 1998, the maximum penalty is a fine of not more than 50,000 Malaysian Ringgit or imprisonment not exceeding one year, or both.
