  • 在听讼案件后，法官可选择立刻做出判决宣读判词，或将案件押后再审，考虑适当的判决。
  • 法官会依据四项原则判定适当的罪刑，即罪犯应得到的报应，对罪犯的预防作用，罪犯有改过自新的意志，与刑罚对社会的威慑作用。
  • 法官宣读判词时，若被告罪名不成立，审讯就此结束。相反，若被告罪名成立，案件便进入求情和判刑阶段。
ETYMOLOGY
  • After hearing the case, the judge has the option to deliver judgment and read the verdict immediately, or adjourn the case to consider the appropriate judgment.
  • The judge will determine the appropriate punishment based on four principles, namely retribution in terms of the punishment the offender deserves, prevention of the offender’s ability to recommit crime, the rehabilitative potential of the offender, and the deterrence of the punishment on the society at large.
  • When the judge reads the verdict, the trial ends if the accused/defendant is not guilty. Conversely, if the accused/defendant is convicted, the case will enter the intercession and sentencing phases.
